CONFLICTS OF ENVIRONMENTAL LAWS: THE PREVALENCE OF PROTECTION

This paper focuses on the analysis of the legislative competence concerning the environment, particularly on the frequent conflicts of laws edited by different federative entities. By examining the limits of the concurrent legislative competence this study comes up with a hermeneutical solution for the regulations disharmony regarding the environmental protection. The prevalence of the most environment-protective regulation is supported from the point view of the maximum efficacy of the fundamental rights. At last, an analysisof concrete cases regarding conflicts of Minas Gerais state legislation with the federal regulation is done.Downloads
