Abstract

It discusses the enactment of Law No. 14.245/2021 and its changes to the Penal Code, the Code of Criminal Procedure and the Law on Special Criminal and Civil Courts (Law No. 9.099/95). The context that led to the enactment of this law is analyzed, based on the pre-trial hearing in which the dignity of the victim Mariana Ferrer was disrespected. It discusses trends in the national system that show concern for the treatment of victims. It concludes with an analysis of the indispensability of the rule in question, along with the criticisms made by those who consider it dispensable, as well as restricting the exercise of a broad defense
