THE COLLECTIVE PROCESS AS A TOOL FOR AN EFFECTIVE ACCESS TO JUSTICE

The aim of this paper is to address the access to justice regarding its effectiveness. Thus, after comments on the referred guarantee, it was about the collective jurisdiction, seeking to demonstrate that the collective process is an appropriate tool for an effective access to justice. Besides that, there are considerations about the role of Prosecutors and the Judiciary as well as the implementation and formulation of public policies, emphasizing the need for compatibility of reserve of the possible with the existential minimum. The importance of care withthis human dignity was highlighted, proclaiming how the collective process benefits the search for the assurance of essential rights. This time, the access to justice in its collective form honors the procedural economy and the principle of equality, promoting, above all, the provision of judicial review.Downloads
