Abstract

The aim of the current study is the analysis of the fundamental rights from the society point of view. It was conceived from the idea that, many times, the individual fundamental rights exercise brings consequences to the social group, putting the fundamental rights of each one of the social group components at risk. An interests’ consideration will solve this collision between individual fundamental rights and society fundamental rights. In the concrete case, it can be done checking what fundamental right must prevail over another. The fundamental rights relative character is analyzed, so that, next to it, the principles collision situation and rules conflict are evaluated. The interests’ consideration exercise is accurately assessed from the reasonability and proportionality, and a special focus towards the qualification of the individual who owns the fundamental right in conflict is given. Collision hypothesis are analyzed, concluding that the recognition of an individual fundamental right is not possible without the interests consideration, with the occasional onus imposed to the society.
