Abstract

The Federal Constitution (1988) secures free manifestation of thought and expression (Article 5º, IV and IX), abiding any form of restraint or censorship to such rights and to freedom of journalistic information, by all means of social communication (Article 220º). However, the Brazilian System of Justice has been hindering some facts regarding public personalities, to become known by general society. The present essay (paper) seeks to discuss censorship and it´s various modalities, alongside with the possibility of its application in concrete cases by the judges and ordinary legislator.
