The constitucional protection of the intimacy and the relations with the investigatory activity of the state

Abstract

The intimacy, although a fundamental right, should give in to other fundamental rights with more social expression, in the form guaranteed by the law and the Constitution. Therefore, new cases law should be created in order to ensure the systematic interpretation of the Constitution and the compliance to international commitments made for Brazil to an efficient battle against organized crime.
