The democratic state law and dignity of the human person: considerations res judicata and research of fatherhood

It is res judicata on the study and investigation of paternity, seen through the prism of the principle of human dignity, the basis of the Federative Republic of Brazil, formed in a democratic state of law. The focus of the democratic rule of law and the grounds on which they excel starts the job. Followed by brief exposure of res judicata, including the theory that admits its relativization. Still dealing with issues like paternity tests and research, leading to a brief analysis of the DNA test and its implications in the search for biological paternal ancestry, commenting on the affiliation. In this context incorporates the changes in society and its impact on family law, the search for biological identity, and very personal right essential element in the formation of human personality, hosted by the principle of human dignity, given, exceptionally, to allow the relativization of res judicata.Downloads
