Abstract

The present work critically analyzes the principle of absolute priority for childhood and adolescence, of constitutional matrix, starting by its legal and doctrinal conceptualization. It also discusses its application, in view of the possibility of conflicts with other principles and fundamental rights, as well as its practical repercussions for the entities obliged to guarantee the rights of this population group, from the perspective of integral protection. It also addresses its application in the field of actions, services and public policies, and its budgetary repercussion, analyzing the limits and the possibilities of acting of society, via councils of rights, in the process of realizing rights and as a priority to this part of the population.

Membro do Grupo de Pesquisa Direito e Realidade Social (CNPq/PUC/Campinas). Doutor e Mestre em Direito Civil pela Pontifícia Universidade Católica de São Paulo - PUC/SP, Possui Graduação em Direito pela Pontifícia Universidade Católica de Campinas (2001). Docente Honorário da Universidade Privada de Tacna/Peru. Professor-Visitante da Universidad Autónoma del Perú.
