DEMOCRACIA: O PAPEL DO MINISTÉRIO PÚBLICO BRASILEIRO
Abstract
Among other purposes, the Constitution of 1988 explicitly assigned to the Brazilian Public Prosecution Office the defense of the democratic regime. It is necessary to correctly understand this concept, which presupposes grasping the true meaning of Democracy, whose expression is today rather modest in Brazil. As for the Public Prosecutor's Office, its performance has historically conformed to the profile of the State. The current Brazilian Constitution and laws have given it many functions and legal instruments, and its present performance is causing uneasiness to businessmen, politicians and government officials. The only support to the Public Prosecution Office comes from its work aimed at defending social interests to accomplish its purpose and serve the population, thus gaining strength for keeping or even enlarging its guarantees and instruments for functional performance.
