A QUESTÃO DA COMPETÊNCIA
Abstract
The scope of the present study was to demonstrate, from the autonomous location of the collective tutelage microsystem and the recognition of the immanent peculiarities of such procedural species, that the interpretation and application of the rules related to competence in the collective process must be guided by the principle of access to the just legal order, which derives from the Democratic State of law, so that priority must be given to meeting the ultimate purpose of the collective process, which is precisely the effective protection of the rights conveyed through this procedural category, applying, when necessary, the postulate of adequate competence.
