Abstract

The process of internalizing environmental issues that are relevant to society has been increasingly present in legislation, and the Public Prosecutor's Office plays a fundamental role in this process. The involvement of the population in environmental proceedings ensures the exercise of the principles of Environmental Law, such as prevention, in addition to contributing greatly to the proposition of appropriate solutions to the local reality. The present work sought to analyze, based on responses obtained through an online questionnaire made available to the Federal and State Public Prosecutor's Offices in São Paulo, the practices of the Parquet as a facilitating agent in the implementation of Participatory Democracy in environmental procedures of the institution. Although the participatory instruments already formalized by the Parquet itself are still prioritized, the opportunity for democratic practice is observed in the course of ministerial procedures, enabling the involvement of the community in proposing solutions and practices more appropriate to the local reality.

    Doutora pela Universidade Federal de Viçosa. Professora Titular do Curso de Especialização em Perícia Judicial, Ambiental e Auditorias do Centro de Ciências Tecnológicas/UNIFESO - Teresópolis/RJ. Pós-doutoranda em Direito Ambiental e Direito Urbanístico junto ao Programa de Pós-graduação em Ciências Ambientais da Universidade Federal de São Carlos (PPGCAm/UFSCar) do Departamento de Ciências Ambientais (DCAm/UFSCar).
